NOTICE OF OPTION TO RECESS INTO EXECUTIVE SESSION
Pursuant to A.R.S. §38-431.02, notice is hereby given to the members of the Heritage Preservation Commission and to the general public that, at this regular meeting, the Heritage Preservation Commission may vote to go into executive session, which will not be open to the public, for legal advice and discussion with the City’s attorneys for legal advice on any item listed on the following agenda, pursuant to A.R.S. §38-431.03(A)(3).

LAND ACKNOWLEDGEMENT
The Heritage Preservation Commission humbly acknowledges the ancestral homelands of this area’s Indigenous nations and original stewards. These lands, still inhabited by Native descendants, border mountains sacred to Indigenous peoples. We honor them, their legacies, their traditions, and their continued contributions. We celebrate their past, present, and future generations who will forever know this place as home.

In response to the emergency flood prevention action to be taken on Schultz Creek approve the following framework in appendices “A” for a Phase 1 Cultural Resource Study (CRS) with a mitigation product to be completed by the Flagstaff Heritage Preservation Officer (HPO) and the City of Flagstaff in order to proceed with an expedited emergency flood control construction project within a designated Landmark Overlay Zone owned by the City of Flagstaff:
Approve the following framework in appendices “A” for a Phase 1 Cultural Resource Study (CRS) with a mitigation product to be completed by the Flagstaff Heritage Preservation Officer (HPO) and the City of Flagstaff in order to proceed with an expedited emergency flood control construction project within a designated Landmark Overlay Zone owned by the City of Flagstaff:
Add additional requirements to the Phase 1 CRS and its proposed mitigation to meet the intent of the heritage preservation ordinance requirements. Parcel was presented to HPC for Local Landmark Overlay protection, approved by HPC and City Council.

Mark Reavis: gave a brief overview of the project and what the commission is being asked to consider and vote on.
Amy Horn: Asked whether there had been any systematic survey of the area at this time?
Mark Reavis: Clarified that there had not been any systematic survey completed. Added that the Federal requirements for the site will include 106 and that the commission is just considering the site's designation as a local landmark.
Amy Horn: Asked whether the 106 process will happen after the commission makes a decision on the overlay?
Sara Dechter: Noted that the NRCS has already initiated the 106 process.
Mark Reavis: Read appendix A of the staff report.
Charles Webber: Asked how the interpretive framework being proposed for mitigation will be funded.
Mark Reavis: Stated that the City has committed to funding the mitigation effort.
Stacey Brechler-Knaggs (City of Flagstaff Grants, Contracts & Emergency Management Director): Confirmed that the interpretive framework would not be funded by the NRCS grant but that the City would find other avenues to fund it.
Charles Webber: Asked whether the NRCS is using a contractor for the project and whether they will produce a report on site findings?
Ed Schenk (City of Flagstaff Stormwater Manager): Noted that NRCS has an archeologist on board for section 106 and that technical assistance could also be included that would include full archeology monitoring and a report. Added that he is confident the interpretive mitigation effort would be completed within the specified time frame.
Charles Webber: Asked about the scale of the project.
Mark Reavis: Specified that the project will disturb about 80% of the site.
Emily Dale: Asked about the project timeline.
Ed Schenk: Clarified that the project is in the works and is anticipated to be completed in a matter of weeks to a month.
Emily Dale: Asked whether the project would come back to the commission at a later date.
Mark Reavis: Stated that he will come back to HPC with the interpretive materials and any reports produced as part of the site.
Emily Dale: Stated that it would be nice to have a visual/map of what was found on the site with any concurrent report.
Charles Webber: Agreed that it would be nice to see any reports and visuals.

Moved by Amy Horn, seconded by Charlie Webber Approve the HPO recommendation in response to the emergency flood prevention action to be taken on Schultz Creek approving the following framework in appendices “A” for a Phase 1 Cultural Resource Study (CRS) with a mitigation product to be completed by the Heritage Preservation Officer (HPO) and the City of Flagstaff in order to proceed with an expedited emergency flood control construction project within a designated Landmark Overlay Zone owned by the City of Flagstaff.
