TITLE:
Consideration and Approval of Settlement: The matter of Kathrin Fox v. City of Flagstaff, case No. S0300 CV2022-00196, currently pending in Coconino County Superior Court.
STAFF RECOMMENDED ACTION:
Approve settlement of the matter of Kathrin Fox v. City of Flagstaff, pursuant to the terms of the Stipulation Regarding Settlement discussed in executive session, and Authorize and direct the City Attorney to execute all documents and take such other actions as are necessary to finalize the settlement.
Executive Summary:
This litigation stems from a bicycle accident involving Ms. Fox that occurred on May 13, 2021, near E. Forest Avenue and N. Gemini Road in Flagstaff. Ms. Fox is alleging injuries and seeking damages as a result of the accident. The City has reached a tentative settlement of this particular litigation, subject to the approval of the City Council. The tentative settlement and legal advice related thereto were discussed with the City Council in executive session on September 19, 2023.
Financial Impact:
Funding for this settlement is available through the City's self-insurance trust fund.
