TITLE:

Consideration and Action on Liquor License Application: Larami Jean Sandlin, "Dark Sky Brewing Company," 103 W. Birch Avenue, Series 03, New License.

STAFF RECOMMENDED ACTION:

Hold the public hearing.

The City Council has the option to:

Forward the application to the State with a recommendation for approval;
Forward the application to the State with a recommendation for denial based on the testimony received at the public hearing and/or other factors.

Executive Summary:

The liquor license process begins at the State level and applications are then forwarded to the respective municipality for posting of the property and holding a public hearing, after which the Council recommendation is forwarded back to the State. The applicant is requesting a Series 03 (in-state microbrewery) license for their location on Birch Avenue. Dark Sky Brewing Company was granted a Series 03 (in-state microbrewery) in June 2022.

A Series 03 license allows an in-state microbrewery to sell beer produced or manufactured on the premises for consumption on or off the premises; they may sell to in-state and out-of-state licensed wholesalers and retailers. Beer produced or manufactured on the premises may be served for the purpose of sampling. If approved, this will be the 11th active series 03 license in Flagstaff.

The property has been posted as required, and the Police and Community Development divisions have reviewed the application and provided their respective reports.

Financial Impact:

There is no budgetary impact to the City of Flagstaff as this is a recommendation to the State.

Liquor licenses are a regulatory action and there is no Council goal that applies.

Because the application is for a new license, consideration may be given to both the location and the applicant's personal qualifications.

The deadline for issuing a recommendation on this application is September 25, 2023.

The application was properly posted on August 29, 2023. No written protests have been received to date.
