Consideration and Possible Adoption of Ordinance No. 2023-21: An Ordinance of the City Council of the City of Flagstaff, extending and increasing the corporate limits of the City pursuant to the provisions of Title 9, Chapter 4, Arizona Revised Statutes, by annexing approximately 1.82 acres of land located at 2445 S. Woody Mountain Road, which certain land is contiguous to the existing corporate limits of the City of Flagstaff, and establishing city zoning for said land as Rural Residential (RR); providing for severability, authority for clerical corrections, and establishing an effective date. Executive Summary: |
An Annexation request from Vintage Partners and Liv Communities, LLC of approximately 1.82 acres located at 2445 S. Woody Mountain Road. The property is identified as a portion of Coconino County Assessor’s Parcel Number 112-01-712 which is approximately 13.01 acres and the adjacent S Woody Mountain Road right-of-way . This annexation request is the first part of a two-part request. The second part of the request is a Direct to Ordinance Zoning Map Amendment to rezone from RR to High Density Residential (HR). |
Financial Impact: |
The purpose of this annexation is to develop the entire parcel under the City's HR zoning. Currently, the site has access directly onto either City or ADOT maintained roadways. The property may be served with adjacent City water and sewer. No additional maintenance costs will be incurred through the annexation of this County property. |

Background/History: |
The applicant is requesting to annex approximately 1.82 acres at the intersection of W Route 66 and S Woody Mountain Road. The area subject to the annexation is a portion of parcel 112-01-712 and the adjacent Woody Mountain Road ROW. This parcel is currently vacant and was at one time heavily forested before the Woody Fire in 2006. The parcel is located within the Resource Protection Overlay (RPO) zone and still maintains forest resources towards the southern portion of the property. The parcel is located within the Urban Growth Boundary and this small portion of the overall parcel is within County jurisdiction.
This annexation is the first of a two-step process. The second being a Direct to Ordinance Zoning Map Amendment request to zone the parcel to the HR zone for the construction of a 214-unit for-rent multi-family residential development, associated parking, landscaping, outdoor amenities, clubhouse, and fitness building. The Zoning Map Amendment application is being processed concurrently with this application but will not become effective until after the annexation has been completed. Community Involvement: |
The applicant held two neighborhood meetings regarding this case and the Zoning Map Amendment on December 12, 2022 and February 6, 2023. Both meetings were held virtually. Per the meeting sign-in, approximately 18 individuals attended the first meeting and 4 attended the second meeting. A Citizen Participation Report is attached and includes responses to any questions, comments and concerns presented. The meetings included a presentation from the applicant and a question-and-answer session. Comments on the project included the topics of traffic and the lack of commercial development.
Notice of the Planning and Zoning Commission meeting was provided by placing an ad in the Daily Sun, posting notices on the property, and mailing a notice to all property owners within 300 feet of the site excluding rights-of-way. The Planning & Zoning Commission met on Wednesday, July 26, 2023 at 4 pm. No members of the public commented on this item. The Commission recommended approval of the annexation by a unanimous vote (6-members present).
Public hearings before the City Council are conducted in conjunction with requests for annexation. In accordance with State statute, notice of the public hearing was provided by placing an ad in the Daily Sun, posting notices on the property, and mailing a notice to all property owners within 300 feet of the site. The notices were also provided to the County Assessor, County Community Development Department, and the Chair of the Board of Supervisors. |
