TITLE:
Consideration and Approval of Contract:  Cooperative Purchase Contract with Empire Southwest, LLC for a CAT 2023 4x4 Backhoe in the amount of $188,387.92 utilizing the City of Tucson Cooperative Contract #212816-01. 
STAFF RECOMMENDED ACTION:
  1. Approve the Cooperative Purchase Contract with Empire Southwest, LLC for a CAT 2023 4x4 Backhoe in the amount of $188,387.92 utilizing the City of Tucson Cooperative Contract #212816-01; and
  2. Authorize the City Manager to execute the necessary documents.
Executive Summary:
The Streets Section is replacing a 1998 CASE backhoe which has reached it end of life for the Streets Section. The purchase of the 2023 CAT 4x4 Backhoe will continue the mission of supporting street maintenance, alley maintenance, concrete replacement, snow operations, and other construction related projects in the Streets Section.
 
Streets and Fleet Services determined that there is enough life left in the 1998 backhoe to support PROSE at the City cemetery with their need for an additional backhoe. By transitioning this 1998 backhoe to the City cemetery, PROSE will be able to maximize the use of their newer backhoe fulltime in snow, and emergency response operations while having adequate coverage at the cemetery.
Financial Impact:
The Streets Section budgeted for this backhoe to be replaced in FY24 budget cycle for $220,000. This purchase will be solely funded by Highway User Revenue Funds (HURF) in account 040-06-161-0614-6-4401.
Policy Impact:
The Street Section is posed to better serve the public through continued transportation network services including; preventative maintenance work on roadways, alley maintenance, emergency response efforts, and snow operations. This will help ensure the city keeps moving forward on its promise to delivery the highest levels of service possible to citizens.

Streets continues to work towards the City goal to be carbon neutral by 2030 by purchasing equipment with old non emission compliant drivetrain with new enhance carbon emission systems the significantly reduce carbon emissions through the new CAT tier 4 carbon emission system with the additional diesel particulate filter system.

Background/History:
The Purchasing section has reviewed the competitively solicited cooperative purchase options available and confirmed that the City of Tucson procurement department conducted a competitive and open procurement process through Request for Proposal Solicitation No. 212816 that resulted in Contract No. 212816-01 with Empire Southwest, LLC that is valid and within the scope of the materials and services requested.
